Shelter Club Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Shelter Club, including our website, Home Health Check, reports, rankings, Find a Professional features, and related services.

By creating an account or using Shelter Club, you agree to these Terms. If you do not agree, do not use the service.
1. What Shelter Club Does
Shelter Club provides technology designed to help homeowners better understand visible aspects of their home's exterior condition and make more informed home-maintenance and improvement decisions.
Features may include:
- AI-assisted Home Health Checks
- Human-reviewed observations
- Home Health Scores and condition information
- Educational information and recommended next steps
- Community and city rankings
- Historical Home Health Checks
- Find a Professional
- Other home-related decision tools
Shelter Club is intended to provide information and decision support. It does not replace qualified professionals.
2. Home Health Checks Are Not Professional Home Inspections
This is particularly important.
A Shelter Club Home Health Check is not a professional home inspection and should not be treated as one.
Shelter Club does not provide engineering, architectural, structural, roofing, electrical, plumbing, environmental, code-compliance, insurance, appraisal, legal, or other licensed professional services.
A Home Health Check is based primarily on the exterior photographs and information available to Shelter Club.
It may identify visible conditions that appear relevant, but it cannot inspect areas that are hidden, obstructed, underground, inside walls, underneath materials, inaccessible, outside the submitted photographs, or otherwise not reasonably visible from the information provided.
Shelter Club cannot determine with certainty whether a building component is safe, code-compliant, properly installed, structurally sound, watertight, or free from hidden defects.
If you need a professional inspection, diagnosis, estimate, engineering opinion, code determination, or other professional service, you should consult an appropriately qualified professional.
3. Artificial Intelligence and Human Review
Shelter Club uses artificial intelligence to assist in analyzing home photographs and related information.
AI systems can make mistakes.
They may:
- Miss visible conditions
- Misidentify materials or components
- Misinterpret photographs
- Overstate or understate the significance of a condition
- Produce incomplete information
- Reach an incorrect conclusion
Shelter Club currently uses human review before publishing homeowner-facing Home Health Check results. Human review is intended to improve quality, but it does not eliminate the possibility of errors or omissions.
Neither AI analysis nor human review creates a guarantee that every existing or developing condition has been detected.
You should use Shelter Club as one source of information when making decisions about your home.
4. Photographs and Image Limitations
The quality of a Home Health Check depends substantially on the photographs provided.
Lighting, distance, image resolution, viewing angle, weather, landscaping, obstructions, building height, camera quality and other factors can affect what Shelter Club can assess.
Shelter Club does not physically visit the property as part of a standard Home Health Check.
Conditions may also exist outside the areas shown in your photographs.
A finding that a system appears to be in good condition does not mean that the system is defect-free or that no repair, maintenance, replacement, or professional inspection is necessary.
5. Emergencies and Safety Issues
Do not rely on Shelter Club to identify or respond to emergencies.
If you believe there may be an immediate threat involving structural failure, fire, electrical hazards, gas, flooding, severe water intrusion, dangerous materials, personal safety, or another emergency, contact the appropriate emergency service or qualified professional.
Do not delay necessary emergency or professional assistance while waiting for a Shelter Club assessment.
6. Scores, Conditions and Rankings
Shelter Club may generate Home Health Scores, condition bands, system assessments, rankings, comparisons, and similar information.
These are Shelter Club's proprietary informational measures based on our methodology and the information available to us.
They are not:
- Property appraisals
- Market valuations
- Engineering assessments
- Professional home-inspection ratings
- Insurance risk scores
- Credit assessments
- Guarantees regarding property condition
- Predictions of future repair costs or property performance
Rankings compare eligible Shelter Club homes using Shelter Club's methodology.
A ranking does not mean one property is objectively “better,” safer, more valuable, or more desirable than another property.
Rankings may change as additional homes participate, assessments expire or are updated, and Shelter Club's eligible comparison population changes.
7. Sharing Rankings
Shelter Club may allow you to voluntarily share a ranking card or similar content.
You control whether you initiate that sharing.
Before sharing, review the information shown on the card. Once you share content publicly or through another platform, Shelter Club cannot control how other people or third-party platforms use or redistribute it.
8. Find a Professional
Shelter Club may help users identify, request, or connect with home-service professionals.
Unless Shelter Club expressly states otherwise, professionals available through Shelter Club are independent businesses and are not employees, agents, partners, or representatives of Shelter Club.
A recommendation, match, profile, recognition level, Trust Score, Beacon designation, or other Shelter Club indicator does not guarantee:
- Workmanship
- Pricing
- Availability
- Licensing
- Insurance
- Safety
- Code compliance
- Financial condition
- Customer service
- Project outcome
- Warranty performance
- Continued qualification
Shelter Club may use information available to us to evaluate professionals, but circumstances and qualifications can change.
You are responsible for deciding whether to hire a professional and should perform whatever independent verification you consider appropriate before entering into an agreement.
9. Your Contract With a Professional
Unless we expressly state otherwise for a particular service, any contract for inspection, repair, replacement, construction, maintenance, or other home services is between you and the professional.
Shelter Club is not a party to that contract.
The professional is responsible for its work, employees, subcontractors, permits, licensing, insurance, pricing, warranties, representations and legal obligations.
Any dispute regarding the professional's work should generally be addressed with that professional, subject to any rights you may have under applicable law.
Nothing in these Terms eliminates responsibility Shelter Club may have for its own conduct where liability cannot legally be excluded.
10. Contractor Matching
Shelter Club may use information about your home, visible conditions, requested systems, project needs, timing and other relevant factors to help identify professionals who may be appropriate for your situation.
A match is not a guarantee that a professional is the best provider for you.
Shelter Club may receive compensation in connection with professional opportunities or introductions.
Where Shelter Club introduces paid professional participation in the future, payment by a professional does not entitle that professional to alter your Home Health Check findings or purchase a better Home Health Score or ranking.
11. Your Account
You must provide accurate information when creating and maintaining your account.
You are responsible for maintaining the confidentiality and security of your login credentials and for activity conducted through your account.
Notify us if you believe your account has been accessed without authorization.
You may not impersonate another person or create an account using information you do not have permission to use.
12. Property and Photo Permissions
By uploading photographs or information to Shelter Club, you represent that you have the right to provide that content for the purposes described in these Terms and our Privacy Policy.
You should not intentionally upload:
- Photographs you do not have permission to use
- Images primarily depicting people without appropriate permission
- Images intentionally capturing private areas of neighboring properties
- Unnecessary sensitive personal information
- Illegal content
You remain responsible for the content you submit.
13. Your Content
You retain ownership of photographs, written information and other original content you submit to Shelter Club.
You grant Shelter Club a limited, non-exclusive license to host, store, reproduce, process, analyze, transmit and display your content only as reasonably necessary to operate, secure, maintain, support and provide Shelter Club and its features, and as otherwise described in our Privacy Policy.
This license allows us, for example, to store photographs, process them using service providers, perform AI analysis, conduct human review and display your report back to you.
It does not transfer ownership of your photographs to Shelter Club.
14. Shelter Club Intellectual Property
Shelter Club and its licensors own the Shelter Club service and its original technology, branding, software, designs, methodologies, report formats, scoring systems, ranking systems, text, graphics and other proprietary materials, except for content owned by users or third parties.
You may use Shelter Club for your personal and other authorized purposes, but you may not copy, scrape, reverse engineer, reproduce, republish, sell, exploit, or create competing datasets from Shelter Club's proprietary content or systems except where applicable law expressly permits it.
15. Acceptable Use
You may not use Shelter Club to:
- Violate applicable law
- Access another user's account or private information
- Circumvent authentication or security controls
- Abuse Health Check limits
- Manipulate rankings
- Submit fraudulent requests
- Interfere with Shelter Club's infrastructure
- Introduce malicious code
- Use automated systems to scrape or overwhelm the service
- Attempt to extract confidential prompts, credentials or security information
- Misrepresent Shelter Club reports or rankings
- Use the service to harm another person
We may restrict activity reasonably believed to threaten Shelter Club, our users, our service providers, or the integrity of the service.
16. Availability and Changes
Shelter Club is an evolving service.
Features may be added, modified, limited, suspended, or discontinued.
We do not guarantee that every feature will always be available or that Shelter Club will operate without interruption or errors.
During beta or early-access periods, features may change more frequently and may have capacity or usage limits.
17. Account Suspension and Termination
We may suspend or terminate access where reasonably necessary because of:
- Material violations of these Terms
- Fraud or abuse
- Attempts to circumvent service limits
- Security threats
- Illegal activity
- Serious misuse of Shelter Club
- Legal requirements
Where appropriate, we may provide notice or an opportunity to resolve the issue.
You may stop using Shelter Club at any time and may permanently delete your account through the available account controls.
Our Privacy Policy explains what happens to personal information following deletion.
18. Third-Party Services
Shelter Club relies on third-party technology and service providers.
Your use of third-party websites, professionals, social networks or services may also be subject to their own terms and privacy practices.
Shelter Club is not responsible for independent third-party services merely because Shelter Club links to or interoperates with them.
19. No Warranty
To the extent permitted by applicable law, Shelter Club is provided on an “as is” and “as available” basis.
We do not warrant that Shelter Club will:
- Identify every home condition
- Produce error-free results
- Prevent future damage
- Accurately predict remaining service life
- Identify hidden defects
- Identify every safety issue
- Guarantee contractor performance
- Be continuously available
Some jurisdictions do not permit certain warranty exclusions. Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Shelter Club and its officers, directors, employees and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of Shelter Club.
This may include losses resulting from reliance on an assessment, an undetected condition, contractor conduct, property damage, lost data, service interruption, or decisions made using Shelter Club information.
Nothing in these Terms limits liability that cannot lawfully be limited, including rights or remedies available under applicable consumer-protection law.
Any specific monetary liability cap should be finalized with legal counsel once Shelter Club's operating entity and commercial model are finalized.
21. Consumer Rights
These Terms do not waive rights that cannot legally be waived.
Users in Canada and the United States may have mandatory consumer-protection rights under federal, provincial, state, or local law.
If any provision of these Terms conflicts with a mandatory legal right applicable to you, that mandatory right controls to the extent of the conflict.
22. Privacy
Our Privacy Policy explains how Shelter Club collects, uses, discloses, retains and protects personal information.
The Privacy Policy forms an important part of your relationship with Shelter Club and should be reviewed before submitting a Home Health Check.
23. Changes to These Terms
We may update these Terms as Shelter Club changes.
When we make changes, we will update the effective date.
If a change materially affects your rights or obligations, we will provide additional notice or obtain agreement where required by applicable law.
Continued use following an effective update constitutes acceptance where permitted by law.
24. Governing Law and Disputes
Shelter Club operates for users in both Canada and the United States.
The governing-law, jurisdiction, and dispute-resolution provisions for these Terms will be finalized based on Shelter Club's legal operating entity before public launch.
Nothing in a future governing-law provision will deprive a consumer of mandatory protections that apply in their jurisdiction.
